Throughout these Terms of Service, the terms “JUE & YUE,” “we,” “us,” and “our” refer to the operator of this website and online store. We provide this website, together with all related information, content, features, tools, products, and services made available through it (collectively, the “Services”).

Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to offer our products and Services to you.

By accessing our website, placing an order, creating an account, or otherwise using the Services, you agree to be bound by these Terms of Service and any policies incorporated into them, including our Privacy Policy, Refund Policy, and Shipping Policy.

If you do not agree to these Terms, please do not access or use the Services.

Nothing in these Terms is intended to limit or exclude any consumer rights that cannot lawfully be limited or excluded under applicable law.

Eligibility and Accounts

By using the Services, you confirm that you have reached the age of legal majority in your country or region of residence. Alternatively, you confirm that you have given permission for any minor dependent under your supervision to use the Services.

Product Information

However, colors and appearances may vary slightly due to screen settings, photography, lighting conditions, production processes, material characteristics, or the handmade nature of certain products.

Minor variations in texture, finish, shape, stone appearance, plating, or measurements may occur and do not necessarily constitute a defect.

Product descriptions, specifications, prices, and availability may be updated at any time without notice. We may discontinue products or limit the quantities available for purchase.

Nothing in this section affects any rights you may have where a product is faulty, damaged, unsafe, or materially different from its description.

Orders and Order Acceptance

Submitting an order constitutes an offer to purchase the selected products.

An order is not considered accepted until we send an order confirmation and successfully receive or authorize payment. An automated acknowledgement that we have received your order does not necessarily constitute acceptance.

We may refuse, limit, cancel, or request additional verification for an order where reasonably necessary, including where:

• A product is unavailable;
• Pricing or product information contains an error;
• Payment cannot be authorized;
• We reasonably suspect fraud, unauthorized activity, misuse, or commercial resale;
• Shipping restrictions prevent us from fulfilling the order; or
• The order violates these Terms or applicable law.

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.

Once an order has entered processing, cancellation may not be possible. Any cancellation or return request will be handled in accordance with our Refund Policy and applicable consumer law.

Products purchased through the Services are intended for personal use unless otherwise agreed by us in writing.

Prices, Currency, and Payment

Product prices may change without notice.

Unless otherwise stated at checkout, displayed product prices may exclude shipping charges, import duties, customs fees, taxes, and other government charges.

The final amount payable will be shown at checkout before you complete your purchase.

We are not responsible for exchange-rate differences or foreign transaction fees imposed by your bank, card issuer, or payment provider.

Unless expressly stated otherwise at checkout, these charges are the responsibility of the recipient and are not included in the product price or shipping charge paid to us.

We are not responsible for delays caused by customs inspections or for charges imposed by customs authorities, except where applicable law requires otherwise.

Shipping and Delivery

Shipping methods, estimated processing times, and estimated delivery periods are described in our Shipping Policy or displayed at checkout.

Delivery dates and transit times are estimates unless we expressly state otherwise. Delays may occur due to customs procedures, carrier disruptions, weather, public holidays, incorrect address information, or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. Additional shipping costs caused by an incorrect or incomplete address may be charged where permitted by law.

Risk of loss or damage will pass in accordance with applicable law. Nothing in these Terms transfers risk to a consumer earlier than permitted under mandatory consumer protection law.

Please inspect your order after delivery and contact us promptly if the package or product appears damaged, defective, incomplete, or incorrect.

Returns, Refunds, and Exchanges

Returns, refunds, and exchanges are governed by our Refund Policy, which forms part of these Terms.

Any return conditions stated in our Refund Policy are subject to consumer rights that cannot be excluded or restricted under applicable law.

Where a mandatory cancellation, withdrawal, guarantee, repair, replacement, or refund right applies, that statutory right will take priority over any inconsistent provision in our policies.

Promotions, Discounts, and Gift Cards

Promotional offers, discount codes, and gifts with purchase may be subject to additional conditions, including eligibility requirements, validity periods, minimum purchase amounts, product exclusions, or usage limits.

• Promotional codes cannot be combined;
• Promotional codes have no cash value;

Nothing in these Terms grants you ownership of, or any license to use, our trademarks, trade names, logos, or other brand identifiers except as expressly permitted in writing.

Third-party services are made available for convenience and may be subject to their own terms and privacy policies. We do not control and are not responsible for third-party websites or services, except to the extent responsibility cannot be excluded under applicable law.

We process personal information in accordance with our Privacy Policy.

Personal information may also be processed by Shopify, payment providers, shipping carriers, fraud-prevention providers, analytics services, marketing providers, and other service providers where necessary to operate the store, fulfill orders, process payments, prevent fraud, communicate with you, or comply with legal obligations.

Reviews, Feedback, and Submissions

When you voluntarily submit a review, photograph, comment, suggestion, idea, or other content to us, you confirm that you have the necessary rights and permissions to do so.

You grant JUE & YUE a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, translate, display, and distribute that submitted content for legitimate business, promotional, and operational purposes.

This license does not transfer ownership of your content to us.

You must not submit content that is unlawful, misleading, defamatory, abusive, obscene, infringing, or that violates another person’s privacy, intellectual property, or other rights.

We may remove or decline to publish submitted content where reasonably necessary.

Errors, Inaccuracies, and Omissions

Occasionally, information made available through the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, shipping charges, transit times, or other details.

We may correct errors and update information where reasonably necessary.

If an error materially affects an order you have placed, we will notify you and, where appropriate, offer you the option to proceed on the corrected terms or cancel the affected order for a refund.

Nothing in this section limits rights available to you under applicable consumer law.

Termination does not affect rights and obligations that arose before termination.

Provisions that by their nature should survive termination—including those concerning intellectual property, payment obligations, disclaimers, liability, and dispute resolution—will continue to apply.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and Services are provided on an “as available” basis.

We do not guarantee that the Services will always be uninterrupted, secure, error-free, or available at all times.

However, nothing in these Terms excludes or limits:

• Statutory guarantees or warranties that cannot legally be excluded;
• Rights relating to faulty, unsafe, damaged, or misdescribed products;
• Liability for fraud or fraudulent misrepresentation; or
• Any other liability that cannot lawfully be excluded or limited.

Where applicable law provides mandatory product guarantees or consumer remedies, those rights remain unaffected.

To the fullest extent permitted by applicable law, JUE & YUE will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from the use of, or inability to use, the Services.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms excludes or limits liability for:

• Death or personal injury caused by negligence where such liability cannot be excluded;
• Fraud or fraudulent misrepresentation;
• Intentional misconduct or gross negligence where applicable law prohibits limitation;
• Breach of mandatory consumer rights; or
• Any other liability that cannot lawfully be excluded or limited.

Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, the relevant limitation will apply only to the maximum extent permitted by law.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold JUE & YUE harmless from third-party claims, losses, liabilities, and reasonable expenses arising directly from:

• Your unlawful misuse of the Services;
• Your material breach of these Terms;
• Your infringement of another person’s intellectual property or other rights; or
• Content you submit in violation of these Terms.

This provision does not apply to the extent that a claim results from our own negligence, unlawful conduct, or breach of these Terms.

Force Majeure

We will not be responsible for a delay or failure to perform an obligation where the delay or failure results from circumstances beyond our reasonable control.

Such circumstances may include natural disasters, severe weather, fire, epidemics, pandemics, war, civil unrest, labor disputes, government action, customs restrictions, transportation disruption, carrier interruption, power failure, telecommunications failure, or widespread internet disruption.

Where reasonably possible, we will take appropriate steps to minimize the effect of the event and resume performance.

Nothing in this section limits any refund, cancellation, delivery, or other consumer rights that apply under mandatory law.

Severability and Waiver

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or, where necessary, treated as removed.

The remaining provisions will continue in full force and effect.

Our failure or delay in enforcing any provision does not constitute a waiver of that provision or of any other right.

Entire Agreement and Assignment

These Terms, together with the policies and notices incorporated into them, constitute the agreement between you and JUE & YUE regarding your use of the Services and your purchases through the website.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations as part of a merger, restructuring, sale of business, transfer of assets, or similar transaction, provided that doing so does not reduce any mandatory rights available to you.

Governing Law and Dispute Resolution

These Terms are governed by the laws of Taiwan, Republic of China, without regard to conflict-of-law principles.

Any dispute that cannot be resolved informally will be submitted to the courts having jurisdiction in Taiwan.

However, this choice of law and jurisdiction does not deprive a consumer of any mandatory protection or right to bring proceedings in another competent jurisdiction where such rights apply under the laws of the consumer’s place of residence.

Before commencing formal proceedings, you are encouraged to contact us so that we may attempt to resolve the matter directly.

Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, Services, policies, technology, or legal obligations.

The updated version will be posted on this page with a revised “Last Updated” date.

Changes will apply prospectively from the date they are published, unless applicable law requires otherwise.

Your continued use of the Services after an update constitutes acceptance of the revised Terms only to the extent permitted by applicable law.
